Who is eligible to apply for this long-term permit?

Long-term residence permit
It is the situation that authorizes one to reside and work in Spain indefinitely , under the same conditions as Spaniards ( art. 32 of Organic Law 4/2000 ).


Those who have had temporary residence in Spain for five continuous years , who car owner database meet the conditions established by regulation. Periods of prior and continuous residence in other Member States will also be taken into account.
Foreigners who are long-term residents in another Member State of the European Union may apply for and obtain a long-term residence permit in Spain on their own when they are going to carry out an activity on their own or as an employee, or for other purposes, under the conditions established by regulation.
Foreigners who have been granted international protection by Spain or another Member State of the European Union and who are in Spain may apply for and obtain a long-term residence permit in Spain under the conditions established by regulation.
How does this permit expire ?

If the authorization has been obtained in fraud of law
When an expulsion order is issued against the foreigner
When the absence from the territory of the European Union occurs for 12 consecutive months.
When long-term residence is acquired in another Member State.
When, after obtaining authorization from a person to whom another Member State has granted international protection, the authorities of said State have decided to cease or revoke said protection.
How do I apply for a residence permit in Spain?
In order to be authorized for residence, whether temporary or long-term, the foreigner must meet a series of requirements :

Not be a citizen of the European Union, the European Economic Area or Switzerland, nor have relatives in these countries.
Be legally in Spanish territory.
No criminal record in Spain or your country of origin.
Not being prohibited from entering Spain or other countries with which there is an agreement.
Not being within the 3-year commitment period not to return to Spain assumed by foreigners who at some point decide to return to their countries of origin within the voluntary return program.
Procedure for requesting permission
The following documentation must be provided :

Completed and signed application form.
Complete copy of passport, travel document or registration card.
Documentation proving your continued residence in Spain for a minimum of 2 years.
Criminal record certificate.
Documentation proving employment relationships.
The application must be submitted along with the rest of the documentation to the Immigration Office of the province where the foreigner resides at that time. The documents must be translated into Spanish and a fee must be paid .

The Administration will have a period of 3 months to decide and issue the residence permit. After 3 months without any communication, it will be understood as negative silence, that is, the application has been rejected. The next step would be to file a claim in Court.
